PREVENT BIOMETRICS PRIVACY POLICY

At Prevent, we believe in the amazing potential of data to improve the world of sports. We also realize the responsibility that goes with collecting this data, and want to be transparent about how we use it.
The policy below describes the privacy practices for our Impact Monitoring Mouthguards (the “IMMs”), applications, software, websites, APIs, products, and services (collectively, the “Services”). You will learn about the data we collect, how we use it, the controls we give you over your information, and the measures we take to keep it safe. By visiting our website and using our Services, you are accepting the practices described in this Privacy Policy.
All references to “you” and “your” in this policy shall mean individual athletes (or parents or guardians of athletes under 18 years of age) and the organization (a team, school, or other sports organization) to whom consent has been given by the athlete (or the parent or guardian of athletes under 18), to collect, monitor and analyze the data collected on the athlete wearing Prevent’s IMMs.

INFORMATION WE COLLECT
When you use our Services, we collect the following types of information.
INFORMATION YOU PROVIDE US:
ACCOUNT INFORMATION
Some information is required to create an account to use our Services, such as your name, email address, password, date of birth, gender, height, weight, and in some cases your mobile telephone number. This is the only information you have to provide to create an account with us. You may also choose to provide other types of information, such as a profile photo, biography, country information, and community username.
ADDITIONAL INFORMATION
If you contact us or participate in a survey, contest, or promotion, we collect the information you submit in connection with such participation such as your name, contact information, and message.
PAYMENT AND CARD INFORMATION
If you purchase Prevent merchandise on our website, we will collect payment and shipping information, including your name, credit or debit card number, card expiration date, CVV code, billing address and shipping address. We do not store your payment information. We store your shipping address to fulfill your order. Note that third-party payment processors may retain this information in accordance with their own privacy policies and terms.
INFORMATION WE COLLECT THROUGH AUTOMATIC DATA COLLECTION TECHNOLOGIES:
DEVICE INFORMATION
Prevent’s IMMs collect data on the quantity and magnitude of head impacts sustained by the athlete being monitored. When the IMM syncs with our applications or software, data recorded on the IMM is transferred to our servers.
USAGE INFORMATION
When you access or use our Services, we receive certain usage data. This includes information about your interaction with the Services, for example, when you view or search content, install applications or software, create or log into your account or pair your device to your account.
We also collect data about the devices and computers you use to access the Services, including IP addresses, browser type, language, operating system, Prevent or mobile device information (including device and application identifiers), the referring web page, pages visited, location (depending on the permissions you have granted us), and cookie information.
INFORMATION WE RECEIVE FROM THIRD PARTIES
If you choose to connect your account on our Services to your account on another service, we may receive information from the other service. For example, if you connect to Facebook or Google, we may receive information like your name, profile picture, age range, language, email address, and friend list. You may also choose to grant us access to your safety or performance data from another service. You can stop sharing the information from the other service with us by removing our access to that other service.
HOW WE USE YOUR INFORMATION
We use the information we collect for the following purposes.
PROVIDE AND MAINTAIN THE SERVICES
Using the information we collect allows us to provide the key features and functionality of our Services. For example, the monitoring data for individual athletes is made available to authorized coaches, trainers, and other team personnel as a way to identify athletes who may be exposed to high magnitude impacts, and who should be considered for evaluation.
IMPROVE AND DEVELOP THE SERVICES
We use the information we collect to improve the Services and to develop new ones. For example, we use the information to troubleshoot and protect against errors; perform data analysis and testing; conduct research and surveys; and develop new features and Services.
We also use your information to make inferences and provide context for comparison and research. For example, information like your sport, height, weight, gender, and age allows us to improve the performance and effectiveness of the system.
COMMUNICATE WITH YOU
We use your information when needed to send you Service notifications and respond to you when you contact us. We also use your information to promote new features or products that we think you would be interested in. You can control marketing communications and most Service notifications by using your notification preferences in account settings or via the “Unsubscribe” link in an email.
PROMOTE SAFETY AND SECURITY
We use the information we collect to promote the safety and security of the Services, our users, and other parties. For example, we may use the information to authenticate users, facilitate secure payments, protect against fraud and abuse, respond to a legal request or claim, conduct audits, and enforce our terms and policies.
COOKIES
Cookies are unique identifiers that we transfer to your device to enable our systems to recognize your device and to provide certain features. We use cookies and similar technologies for the purposes described above.
The Help feature on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Additionally, you can disable or delete similar data used by browser add-ons, such as Flash cookies, by changing the add-on’s settings or visiting the website of its manufacturer.
DO NOT TRACK SIGNALS
We do not track our customers over time and across third party websites to provide targeted advertising and therefore do not respond to Do Not Track (DNT) signals.
HOW YOUR INFORMATION IS SHARED
We do not share your personal information except in the limited circumstances described below.
WHEN YOU AGREE OR DIRECT US TO SHARE
You may direct us to disclose your information to others, such as to connect with a third-party application. For certain information, we provide you with privacy preferences in account settings and other tools to control how your information is visible to other users of the Services. Remember that the use of your information by third-party applications will be governed by their privacy policies and terms. You can revoke your consent to share with third-party applications using your account settings. Use of individual athlete data within Prevent’s system by authorized team personnel is agreed to as a requirement of an athlete using Prevent’s system while participating in that team’s programming.
FOR EXTERNAL PROCESSING
We transfer information to our corporate affiliates, service providers, and other partners who process it for us, based on our instructions, and in compliance with this policy and any other appropriate confidentiality and security measures. These partners provide us with services globally, including for customer support, information technology, payments, sales, marketing, data analysis, research, and surveys.
FOR LEGAL REASONS OR TO PREVENT HARM
We may preserve or disclose information about you to comply with a law, regulation, legal process, or governmental request; to assert legal rights or defend against legal claims; or to prevent, detect, or investigate illegal activity, fraud, abuse, violations of our terms, or threats to the security of the Services or the physical safety of any person.
Please note: Our policy is to notify you of legal process seeking access to your information, such as search warrants, court orders, or subpoenas, unless we are prohibited by law from doing so. In cases where a court order specifies a non-disclosure period, we provide delayed notice after the expiration of the non-disclosure period. Exceptions to our notice policy include exigent or counterproductive circumstances, for example, when there is an emergency involving a danger of death or serious physical injury to a person.
THIRD-PARTIES
We employ other companies and individuals to perform functions on our behalf. They have access to personal information needed to perform their functions, but may not use it for other purposes. We may share non-personal information that is aggregated or de-identified so that it cannot reasonably be used to identify an individual. We may disclose such information publicly and to third parties, for example, in public reports about sports participation, to partners under agreement with us, or as part of research activities related to head health.
BUSINESS TRANSFERS
If we are involved in a merger, acquisition, or sale of assets, customer information may be one of the transferred business assets. We will continue to take measures to protect the confidentiality of personal information and give affected users notice before transferring any personal information to a new entity.
YOUR RIGHTS TO ACCESS AND CONTROL YOUR PERSONAL DATA
We give you account settings and tools to access and control your personal data, as described below, regardless of where you live.
You can review and change your personal information by logging into the website and visiting your account profile page. You may also send us an email at legal@preventbiometrics.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your account. If you request to review, correct or delete your personal information, we will first ensure that your identity is properly verified and any access rights are authenticated. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
DATA RETENTION
We keep your account information, like your name, email address, and password, for as long as your account is in existence because we need it to operate your account. We keep the information collected by IMMs and linked to your personal information, including an athlete’s name or email address (where applicable), for at least as long as the account is fully paid and current. Once the storage fees for your data are no longer being paid, we may choose to de-identify the data collected by our IMMs and retain it in a manner that would not allow it to be traced back to an individual athlete.
We also keep information about you and your use of the Services for as long as necessary for our legitimate business interests, for legal reasons, and to prevent harm, including as described in the “How We Use Your Information” and “How Your Information Is Shared” sections.
OUR POLICIES FOR CHILDREN
We appreciate the importance of taking additional measures to protect children’s privacy. At this time, Prevent does not allow athletes under 18 years of age to set up their own account. If you are under 18 years of age, do not use or provide any information on this website or through any of its features. Parents or guardians must consent to their child’s use of an IMM and the collection of that data by Prevent’s Services. If we learn that we have collected the personal information of a child under 18 without parental consent, we will take steps to delete the information as soon as possible. Parents who believe that their child has submitted personal information to us and would like to have it deleted may contact us at legal@preventbiometrics.com.
INFORMATION SECURITY
We work hard to keep your data safe. We use a combination of technical, administrative, and physical controls to maintain the security of your data. This includes using Transport Layer Security (“TLS”) to encrypt many of our Services. No method of transmitting or storing data is completely secure, however. If you have a security-related concern, please contact Customer Support.
UPDATES TO OUR PRIVACY POLICY
It is our policy to post any changes we make to our Privacy Policy on this web page. If we make material changes to how we treat our users’ personal information, we will notify you, by email or through a notice on our website home page, and give you an opportunity to review the revised policy before deciding if you would like to continue to use the Services. You can review previous versions of the policy in our archive.
